Terms of Service

The short version
Use TimiiraMato make something for someone who wants to receive it. You keep ownership of everything you create; you give us only the permission we need to store and display it. Do not upload other people's private photos without their agreement, and do not use the service to harass anyone. Coupons are promises between two people, not anything we enforce. The service is provided as-is, and our liability is limited.
1. Agreement to these terms
These Terms of Service (the "Terms") are a binding agreement between you and TimiiraMa (Kathmandu, Nepal), which operates TimiiraMa(the "Service"). By creating an account, playing a shared experience, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains how we handle personal data and forms part of these Terms.
2. Eligibility
You must be at least 18 years old to create an account or to play a shared experience. You must not be barred from using the Service under the laws of your country. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.
3. Your account
- Provide accurate information and keep your email address current.
- You are responsible for everything that happens under your account. Keep your credentials secret and tell us at security@timiirama.com if you suspect unauthorised access.
- One person per account. Do not share logins or impersonate anyone.
- You can delete your account at any time. Deletion removes your content as described in the Privacy Policy.
4. Your content
You own what you create. Photos, memories, messages, challenges, coupons, and wheel options you upload or write remain yours. These Terms transfer no ownership to us.
To operate the Service we need a limited licence. You grant TimiiraMa a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing and re-encoding images), and display your content solely to provide the Service to you and to the people you share it with. This licence exists only for that purpose, ends when you delete the content or your account (subject to the retention periods in the Privacy Policy), and does not permit us to use your content in marketing, to train machine learning models, or to show it to anyone you did not share it with.
By uploading content you confirm that:
- You created it or you hold the rights necessary to upload and share it.
- Anyone identifiable in a photo or story has agreed to your sharing it in this way — this matters most for intimate or private images.
- It does not infringe anyone's copyright, trademark, privacy, or publicity rights.
We do not routinely monitor content, but we may review, remove, or restrict access to content that we reasonably believe violates these Terms or the law.
5. Acceptable use
Do not use the Service to:
- Upload or share sexual images of anyone under 18, or any content that sexualises a minor. We report this to the relevant authorities.
- Share intimate or explicit images of a person without that person's clear agreement, including images obtained during a relationship that has since ended.
- Harass, stalk, threaten, coerce, monitor, or intimidate anyone. An experience sent to someone who has asked you to stop contacting them is harassment, whatever it contains.
- Impersonate another person or misrepresent who you are.
- Post content that is unlawful, defamatory, hateful, or incites violence.
- Upload malware, attempt to access accounts or data that are not yours, probe or overload our infrastructure, scrape the Service, or circumvent rate limits, passcodes, or other technical restrictions.
- Resell, sublicense, or commercially exploit the Service without our written consent.
- Use the Service to send bulk or unsolicited messages.
Report abuse to hello@timiirama.com. If you are being harassed through content hosted here, tell us and we will act on it.
7. Coupons
Coupons created in TimiiraMa are personal promises between two people. They are not vouchers, gift cards, stored value, or any other financial instrument; they have no monetary value; and TimiiraMa does not fulfil, guarantee, track, mediate, or enforce them. Any dispute about a coupon is between the people involved.
8. Third-party content and services
The Watch Night feature displays film and television information sourced from The Movie Database. That data belongs to its respective rights holders, may be inaccurate or incomplete, and is provided for reference only. TimiiraMa does not stream, host, or provide access to any film or television content.
This product uses the TMDB API but is not endorsed or certified by TMDB.
The Service also relies on third-party providers for authentication, storage, and email as listed in the Privacy Policy. Their availability is outside our control.
9. Our rights and the Service itself
TimiiraMa owns the Service — the software, design, brand, and name — and all intellectual property rights in it, excluding your content. We grant you a personal, non-transferable, revocable licence to use the Service under these Terms.
We may change, suspend, or discontinue features at any time. If we discontinue the Service entirely, we will give registered users at least 30 days' notice and a way to export their content.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or to protect the Service or its users. Where circumstances allow, we will tell you why and give you a chance to respond. On termination, sections 4 (as to the licence already exercised), 7, 11, 12, 13, and 15 survive.
11. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law, TimiiraMa disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that content will never be lost.
Keep your own copies. Treat TimiiraMa as a way to present your memories, not as the only place they exist.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the statutory rights your local law gives you.
12. Limitation of liability
To the fullest extent permitted by law, TimiiraMa will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, goodwill, or profits, arising out of your use of the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 50.
13. Indemnity
You agree to indemnify and hold harmless TimiiraMa from any claim, demand, loss, or expense (including reasonable legal fees) brought by a third party arising out of content you uploaded, your use of the Service, or your breach of these Terms or of applicable law.
14. Changes to these terms
We may update these Terms as the Service evolves. The "last updated" date at the top reflects the current version. For material changes we will notify registered users by email at least 14 days before they take effect. Continuing to use the Service after that means you accept the updated Terms; if you do not, delete your account before the change takes effect.
15. Governing law and general terms
- These Terms are governed by the laws of Nepal, and the courts of Nepal have exclusive jurisdiction — without depriving you of the protection of mandatory consumer law in your country of residence.
- If a provision is found unenforceable, the rest stays in force and the provision is narrowed to the minimum extent necessary.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
- These Terms and the Privacy Policy are the entire agreement between you and TimiiraMa regarding the Service.
